1. Identification and Legal Framework

Access to and use of the website [www.fluidhr.ai] and the Fluid HR platform imply full acceptance of these Terms and Conditions. If the user does not agree, they should refrain from using the service.


2. Object

Fluid HR provides a SaaS (Software as a Service) platform for human resources management with modules for recruitment, onboarding, contract management, and time management, including automation features based on Artificial Intelligence (AI).

These Terms regulate access to and use of the services offered by Fluid HR, as well as the rights and obligations of users and the company.


3. Definitions

  • Platform: the Fluid HR system provided via the web.

  • User: any person who accesses or uses the website or platform.

  • Client: individual or entity with an active contract with Fluid HR.

  • Personal Data: information that allows identification of a person, in accordance with GDPR.

  • Content: any information, text, image, file, or data entered or generated by the user on the platform.


4. Conditions of Use

  1. Access to the platform requires registration and authentication with valid credentials.

  2. The user agrees to:

    • Use the service only for legitimate and professional purposes;

    • Not share access credentials;

    • Not interfere with the technical functioning of the platform;

    • Not use the service to send spam, malware, or illegal data.

  3. Fluid HR reserves the right to suspend or terminate accounts that violate these Terms.


5. Intellectual Property

  1. All intellectual property rights over the brand, design, code, AI models, documentation, and other content belong exclusively to FLUIDSIDE – UNIPESSOAL LDA.

  2. The copying, reproduction, modification, distribution, or commercialization of any part of the service without prior written permission is prohibited.

  3. The user retains ownership of the data and content they input into the platform, granting Fluid HR a limited, non-exclusive, and revocable license for technical and operational processing of that data.


6. Confidentiality and Data Protection

Fluid HR commits to treating all data and information with confidentiality and security, in accordance with the Privacy Policy and the Regulation (EU) 2016/679 (GDPR).

The data processed on the platform is intended solely for contractual purposes and will not be used for other purposes without explicit consent.


7. Responsibility

  1. Fluid HR adopts appropriate technical and organizational measures to ensure the availability and integrity of the services.

  2. However, it is not responsible for:

    • Temporary service interruptions caused by maintenance, technical failures, or force majeure;

    • Data loss resulting from misuse or negligence by the user;

    • Content entered or shared by third parties through the platform.

  3. Fluid HR does not guarantee that the service is free from errors or vulnerabilities, but commits to correcting them diligently as soon as identified.



8. Limitation of Liability

To the maximum extent permitted by law, Fluid HR shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, revenues, or data arising from the use or inability to use the service.


9. Changes and Updates

Fluid HR may update these Terms at any time, with prior notice to users.
Changes take effect 15 days after publication on the website, unless legally stated otherwise.

Continuous use of the platform after the update constitutes tacit acceptance of the new Terms.


10. Applicable Law and Jurisdiction

These Terms are governed by Portuguese law.
In the event of a dispute, the Judicial Court of the District of Lisbon Oriente is competent, with express waiver of any other.
